Welcome to Altus Auto Auction!  These Terms of Service ("Terms") govern your access to and use of our website (www.altusaa.com), including our services for consignment, sales, purchases, and online bidding.  By using our website, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Who We Are

Altus Auto Auction is a licensed dealers-only auto auction located at 20684 US Highway 62, Altus, OK  73521.  Our website is exclusively for licensed vehicle dealers to consign vehicles, view sales and purchase information, and bid online once registered and approved.

2. Eligibility

To use our services, you must:

  • Be a licensed vehicle dealer with a valid dealer license.
  • Be at least 18 years old and authorized to act on behalf of your dealership.
  • Register an account and, for online bidding, be approved by Altus Auto Auction.

We reserve the right to refuse service to anyone who does not meet these criteria or violates these Terms.

3. Account Registration and Security

To access our services, you must create an account by providing accurate and complete information, including all required license and bond information.  You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activities under your account, whether authorized by you or not.
  • Notifying us immediately at support@altusaa.com if you suspect unauthorized use.

We may suspend or terminate your account if we suspect misuse or noncompliance with these Terms.

4. Services Provided

a. Consignment

You may consign vehicles for auction by submitting accurate details (e.g., VIN, condition).  We act as an intermediary and are not responsible for the accuracy of your listings.

b. Sales and Purchases

We provide information on your sales and purchases, including market reports of recently sold vehicles.  All transactions are final once completed, subject to our payment and title transfer policies.

c. Online Bidding

Registered and approved dealers may bid online.  Bids are binding; if you win, you agree to pay the bid amount plus applicable fees within the specified timeframe. We reserve the right to reject or cancel bids at our discretion.

5. Fees and Payment

You agree to pay all fees associated with our services, including consignment fees, buyer’s premiums, and transaction fees, as outlined in your dealer agreement or on our website.  Payments must be made promptly according to our terms. Late payments may incur penalties or account suspension.

6. User Conduct

You agree not to:

  • Use our website for any illegal or unauthorized purpose.
  • Misrepresent your identity or dealership status.
  • Submit false or misleading consignment information.
  • Interfere with our website’s functionality (e.g., hacking, bots).
  • Share your account credentials with unauthorized users.

Violation of these rules may result in account termination and legal action.

7. Intellectual Property

All content on our website (e.g., logos, text, market reports) is owned by Altus Auto Auction or its licensors and protected by copyright and trademark laws.  You may not reproduce, distribute, or modify this content without our written permission, except for personal use related to our services.

8. Disclaimers

Our services are provided “as is” without warranties of any kind, express or implied. We do not guarantee:

  • The accuracy of consignment listings or market reports.
  • Uninterrupted or error-free access to our website.
  • The outcome of any auction or bid.

Vehicle sales are “as is, where is,” with no warranties from Altus Auto Auction beyond what the seller provides.

9. Limitation of Liability

To the fullest extent permitted by law, Altus Auto Auction, its affiliates, and employees are not liable for any indirect, incidental, or consequential damages arising from your use of our services, including lost profits or data.  Our total liability is limited to the fees you paid us in the past 30 days.

10. Indemnification

You agree to indemnify and hold Altus Auto Auction harmless from any claims, damages, or losses resulting from your breach of these Terms, misuse of our services, or inaccurate consignment information.

11. Termination

We may suspend or terminate your access to our website at our discretion, with or without notice, for reasons including violation of these Terms, suspected fraud, or inactivity.  Upon termination, your right to use our services ends, but obligations (e.g., payment) remain.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of Oklahoma, USA. Any disputes will be resolved in the state or federal courts of Jackson County, Oklahoma.  You agree to submit to this jurisdiction.

13. Changes to These Terms

We may update these Terms to reflect changes in our services or legal requirements.  We’ll notify you via email or a website notice. Continued use after updates constitutes acceptance of the new Terms.
